Property Sales

Once you have decided to sell your home or property you are responsible for providing the Real Estate Agent with a Contract of Sale.

A Contract of Sale includes a number of searches and certificates that must be obtained from Various Government Departments:

  1. Title Search shows the owner of the property and boundaries of the property. It provides details of any easements, restrictions etc.
  2. Section 149 certificate describes the zoning of the property.
  3. Sewer diagram
  4. Home owners warranty insurance in those instances where, after 1977, work valued at more than $12,000 has been completed.

In addition to the above, special conditions may be required to protect your interests.

Prior to completion of the contract we will seek your instruction regarding:

  • Inclusions: Items that remain when the property is sold.
  • Exclusions: Items which are part of the property but which you wish to take when vacating the premises.
  • Settlement Date: The date you will vacate the premises and receive the funds.

Once completed we will take you through the Purchase Contract to ensure it meets your instructions and that you have a clear understanding of its contents.

When a purchaser has been found for your property, we will provide them with a copy of the Contract of Sale. An exchange of contracts will occur when the purchaser accepts the terms and conditions of the contract.

Should you be purchasing another property at the same time, we will arrange an exchange of both your sale and purchase simultaneously to ensure the moving dates are the same.

Once the contracts are exchanged, we will:

  • If applicable, arrange and discharge of mortgage and payout figures
  • Manage the settlement process.
